Understanding Nikāḥ: Its Importance, Legal Status, Objectives, and Etiquettes and Conditions in the Light of the Teachings of Prophet Muḥammadص
Abstract
This study explores the concept of Nikāḥ (marriage) in Islamic law, focusing on
its importance, legal status, and associated rules and conditions. The first
chapter examines the linguistic and terminological meanings of Nikāḥ,
emphasizing its significance in divine religions such as Judaism, Christianity,
and Hinduism, alongside its central role in the Qur'an and Hadith. It discusses
the legal rulings related to Nikāḥ and its implications. The second chapter
highlights the legal nature of Nikāḥ, distinguishing it from a regular contract
and illustrating that Nikāḥ is rooted in religious and moral principles, unlike
contracts which are primarily based on worldly benefits. The chapter further
elaborates on the objectives of Nikāḥ, including spiritual completeness, family
protection, fulfillment of sexual desires, and the propagation of the Muslim
community, as well as safeguarding chastity and promoting stability. The third
chapter addresses the etiquettes and conditions of Nikāḥ, detailing its essential
elements, prerequisites, and recommended practices. It also outlines
prohibitions related to suckling, kinship, and marriage ties, along with a
discussion on mahr (dower), its determination, and common issues related to it.
The study concludes by emphasizing the benefits of Nikāḥ in fostering societal
harmony and fulfilling religious obligations
