Women's Inheritance: Problems in Pakistani Society andTheir Solutions in the context of Seerat-e-Tayyiba

Abstract

This paper aims to discuss the prime aspects of the rights of inheritance for women in Pakistan. it has clearly mentioned in Quran and Hadith that the right of inheritance preserved for the women as well as for the men. Civil law of Pakistan also provides the women with full security regarding this. Despite this force of Law and Sharia, there are countless cases in courts of Pakistan being heard by Civil, High and supreme court which indicate that the exploitation of women right in inheritance is taking place at large scale. It is important to take this sensitive situation into account and spread light on it with the intention to explore the core issue in order to raise the voice about women rights. Courts in Pakistan have paid particular attention toward solving this problem and a number of judgments have come into appearance which are helpful to understanding the reasons and causes of this type of exploitations. In this paper, Teachings of Quran and Hadith have been put forward regarding women rights in inheritance, followed by presentation of legal judgments about the cases solved by courts.
