Diah for Women: Contemporary Thoughts in the light of Seerat un Nabi (ﷺ)

Abstract

To maintain peace and harmony in society Islam gave due preference to the sanctity of human life. To avoid injustice in society Shariah laws describe different types of parchments, which are a part of Islamic Jurisprudence. One of these punishments is the Diah (Blood money). The Holy Quran permits aggrieved families to take Diah. In the pre -Islamic era Diah was considered a custom related to blood revenge. In the Holy Quran and Hadith Diah is authorized as a kind of retribution for the murder in lieu of Qisas. What is the nature of Diah? , and why the Diah of a woman is half of a man, remained hot topics of debate in the contemporary age. This article heaves light on the different views on the topic from different perspectives. The analytical research methodology will be used in this research. In this article, the Diah of women and Contemporary Thoughts in the light of Seerat-un-Nabi() are discussed. It is concluded that Islam recognized this human practice. Diah is related to customs, so there are different points of view about the Diah of a woman. Although there is an agreement among Islamic scholars (Ijma) on the half Diah of a woman.
